PRO Reference C108 /93 This Indenture made the 30th day of the 8th the fourth yeare of the Raigne of our Soveraigne Lord James the 2nd by the grace of God of England Scotland France and Ireland .....anno domi ; 1688 BETWEEN A B the younger of the parish of Luppitt in the co of Devon yeoman, and C D his son of the one part and E F of Talleton in the co of Devon gent of the other part WHEREAS they the said A B & C D by their deed indented bearing date four days before the date thereof And sealed and delivered and intended for the better execution of these present for the consideration of the sum of five shillings of good and lawful money of England unto them in hand paid by the sd E F at and before then sealing and delivering thereof the receipt which is thereby acknowledged did grant bargain and sell unto him the said E F his executors ...all those three closes or parcels of land or pasture commonly called or known by the name of Rookepath containing by estimation sixteen acres be they more or less with appurtenances now or late in the possession use or occupation of the sd A B And situate and lying and being within the Manor of Ottery Mohune at Mohunes Ottery and parish of Luppitt in the co of Devon And all and singular leases edifices buildings courtilages gardens and orchards at ye present amerced and planted one the same And also all trees woods underwoods hedges ditches commons common of pasture wayes heaths waters watercourses easements profits commodities emolluments and hereditaments whatsoever to the sd closes and rents of lands and premises or to any or either of them ......and with the same at any time before used ...taken reputed deemed or known to the present parties or members thereof ..the commons or common of pasture in all the several wastes commons or common grounds called dampton ?y`ding more Hartridge downe west downe gully cleave old cleave and other the waste grounds within the said manor of Ottery Mohuns in as full large and ample manner ...... And also free liberty at all times to plough break up or till any part of the said common ........ And that ..from all and all manner of former and other bargains sales gifts grants alienations feoffments leases estates jointures dowers annuities rents charges judgements statutes mortgages ...whatsoever heretofore had made committed done acknowledge or suffered to be had made comitted done ...by them the said A B & C D or either of them ..
